My day at the gyno's.

    I know some of you are more than slightly curious about my day at the gyno's. Sorry, that was just a clever ploy to get you to read my thread.

    What this is really about, is how much it sucks dealing with lawyers. I was in a car accident recently and we hit a Fed-Ex truck. It was entirely his fault. He admits it, it's on the police report, and the witness said he saw what happend and that the truck driver was at fault. Anyway, since my job sucks more than Chevy Chase's very shortlived talkshow, I had to keep going to work until 5 days after the accident. When I finally get an appointment with the lawyer, he tells me that he thinks we have a good case, and we should sue. He also says that he gets 30% plus expenses, and that if we don't get a settlement, we don't pay anything (except for the expenses, of course). I then get sent to a doctor of his choosing. This doctor visit is $300, and he sends me for x-rays, with is about another $150 or so, plus prescribes me painkillers that are normally, w/out insurance, $15 a pill. I have 45 of them plus one refill.

    Using math (yay math!) I deduced that if I don't win the case, I'll be out $1125, not to mention the times that I HAVE to call in to work, the gas, and the hours of my life that could be better spent elsewhere, like here at EBWF, instead of waiting in a doctor's office. If I DO win the case, I'll have and am given, lets say, 10,000 for my pain and suffering, I'll actually only get about 6,000 of it. Lets face it though, the most likely end is that I'll get maybe 5,000 before The fee's and 30%. I suppose I can't complain though, money is money, and with Christmas coming up, I'll probably use most of it to buy presents.

    On a side note, if any of you could give me some advice, I would love you forever and even maybe buy you a gift.

    You didn't mention that you were even hurt. Sounds like a scam all around to me.

    Fine, I was hurt, as was my GF and mother. I'm not one of those greedy people that would sue Uncle Ronnie's just because I'm too ignorant to realize that coffee is hot. My neck, shoulder and back are all hurting. My gf cries almost everyday because of the pain, and my mother has been to the ER twice now, because she has seizures and the wreck brought one on, and then she had another two days ago. So I'm not trying to scam anyone. If I were, I'd be wearing a neck brace and complaining of memory loss.

    Sorry if that sounded like I was pissed at you, I'm not, I was just trying to prove my point.

    suing is for pussies. Obviously he didnt do much damage to you because you went to work after the accident. Thats why it's called an accident, but if you're sue happy go for it. Most americans are.

    Ok, let me make it a little more clear for you. Basicly, if I DON'T go to work, I'll be fired, something I can't afford to have happen to me at the moment. My manager told me herself that if I call in again, I'll be fired, or at the very least, my hours will be cut to, oh lets say, about 0 a week. The last time I called in to work, I was given a free 2 week "vacation" to go along with it. As far as me being "sue happy" goes to be honest with you, I'm not looking for money, I just want my medical bills paid and for me not to actually have to pay the lawyer anything out of pocket. If I were sue happy, I'd sue for thousands and thousands. When I said that the most likely outcome was me getting $5,000, I didn't mean that that's what I was going to sue for. I meant that that's what the lawyer will probably get me.

    Maybe you're leaving out part of the story, making it seem like you're sue happy. Did you need medical attention after the accident? Did you call a lawyer first?

    It seems like the Fed-Ex insurance would pay your medical cost, having admitted it was the driver's fault.

    Ok, this is how it happend. My mom was driving, I was in the front passenger seat, and my gf was in the back behind the driver's seat. The truck pulled out of a parking lot, right in front of us to get to the other side of the street. My mom slammed on her breaks, swerved and hit him around the area of his back left tire, with the front left of our car. EMS came and checked us out saying that we were hurt, but that we didn't need to go to the ER, that if we did, they'd only tell us the same thing a doctor would and the release us. My mom went to the doctor that day, as did my gf. I couldn't as I didn't have the money. My mom and dad are the one's who called the lawyer, and then advised my gf and I to talk to him as well. We did, and that's how all this started. I hadn't planned on sueing, my mom just told me to give it a try, that it couldn't hurt.

    As for Fed-Ex paying for anything, the driver of the truck said it was his fault, but the insurance company is now trying to say that they don't know whose fault it is, that my mom might have been speeding. (she wasn't) That's why we had to get the lawyer. If anyone is sue happy, it's my parents. They were talking about wanting the car replaced ('05 Toyota Highlander) with a new car, PLUS a few thousand dollars. I just want the medical bills payed. If I end up with some cash in pocket, then hurray for me.

    The American legal system sucks. In the UK if you sue someone and win then your lawyer costs are put on top of whatever compensation is paid to you. Should be an easy case anyway if the driver admitted fault.
